This Agreement ("Agreement") is made effective by and between LUXE Everyday Inc. (the "Company"), and purchaser of the online/digital program or community membership enrollment (hereafter "Client"), for the purpose of Client purchasing an online/digital program or community membership from the Company. Client agrees to the terms and conditions below by checking the box in the shopping cart checkout, sales page check out or by submitting payment for the online/digital program or community membership.
E-Course and Community Membership Site Terms and Conditions Agreement
E-Course and Community Membership Site Policy
To access the online e-courses or community membership you must attest that you have read and agree to the terms and conditions contained in this E-Course and Community Membership Terms and Conditions Agreement. The term “course” includes the e-course, website pages, courses and all associated materials. The term "membership site" includes the online community, membership site, interviews, trainings, online events, website pages and all associated materials and links. Read this E-Course and Community Membership Terms and Conditions Agreement carefully.
Use of E-Course and Community Membership Site Materials
All courses, processes, interviews, audios, videos, recordings, PDF's, private community social media pages content, content shared live, content shared online, content shared at events both live and online and all associated materials, along with references used in or related to the course or membership site, are the property of Jamie Graff Smith (LUXE Everyday Inc.) and may only be used in the manner detailed in this E-Course and Community Membership Site Terms and Conditions Agreement. Permission to use the material in any other way must be obtained in writing from Jamie Graff Smith or the author of the bonus materials. These materials are for the sole use of individuals registered for the course, membership site or others as approved by Jamie Graff Smith. In the event the Client shares any information publicly they may be removed from the course or membership site at the Company's discretion without warning and without any refunds and it may result in legal action taken by the Company.
As a course or membership site registrant, you may view and read all materials that are part of the course or membership site facility. You may also print any or all pdf file pages for your personal use while taking the course or as an active member on the membership site but you may not share, communicate, publish or in any manner distribute to other parties the course or membership site, login and password, readings, interviews, references, links or any other materials.
The terms and conditions regarding use of materials apply upon registration for the course or membership site, while you are taking the course or are an active member on the membership site, as well as upon and after completing, withdrawing from or terminating the course or your membership site membership.
E-Course or Community Membership Site Access
Only course registrants and membership site members have access to the discussion forums.
Fees and Processing
In consideration for access to the course or membership site, Client agrees to compensate Company the fee indicated on the shopping cart checkout page or on the sales page check out form. If any payment methods are declined by the online payment processor, Client shall provide a new eligible payment method before receiving access to the course or membership site. In the event Client has already been given access to the course or membership site and a payment method is declined, Company reserves the right to collect any and all outstanding receivables.
Personal Information
By purchasing the course or membership site membership, Client will be asked to provide personal information including name, e-mail address, mailing and billing address. Client agrees to allow Company access to this personal information for all lawful purposes. Client is responsible for the accuracy of the identifying information, maintaining the safety and security of the personal identifying information, and updating Company on any changes to the personal identifying information.
The billing information provided to Company by Client will be kept secure and is subject to the same confidentiality and accuracy requirements as Client's identifying information indicated above. Providing false or inaccurate information, or using the course or membership site for fraud or unlawful activity, is grounds for immediate termination from the course or membership site.
Refunds for Courses
You may withdraw from a course at any time. However in order to receive a refund, once you are registered there will be a 30 day refund policy in place. In order to obtain a refund you must submit the full 30 days of reflection questions thoroughly completed for every pdf or video assignment for weeks 1 through 4 of that specific course, via e-mail. Thus, showing that you fully engaged, participated and completed all course materials in the course for the first 30 days. Falsified information and submissions will not be refunded. If you have questions about a specific policy or need to request a refund, please email us at [email protected]. For the avoidance of doubt, unless you are eligible to receive a refund, as provided herein, your obligation to continue to make all monthly payments with respect to a purchase shall remain in effect, notwithstanding the cancellation or termination of the applicable license for such Product
Refunds for Community
You may withdraw from the membership site within 3 days of purchasing. If you have questions about a specific policy or need to request a refund, please email us at [email protected]. For the avoidance of doubt, unless you are eligible to receive a refund, as provided herein, your obligation to continue to make all monthly payments with respect to a purchase shall remain in effect, notwithstanding the cancellation or termination of the applicable license for such Product
Effective Period
The courses are designed to be completed within a period of 6 months. Registrants have access to each course 6 months from the date of purchase unless otherwise noted.
Complaints about a breach of these Participation Rules and/or this E-Course or Community Membership Site Terms and Conditions Agreement should be made by e-mail to [email protected].
Responsibility for Loss
You are responsible for and will indemnify and hold Jamie Graff Smith & LUXE Everyday Inc. harmless from and against any and all liability, claims and losses resulting from your actions in connection with taking the courses or participating in the membership site and your breach of any terms and conditions of this E-Course and Community Membership Site Terms and Conditions Agreement.

Attestation

Disciplinary Action
Registrants are deemed and presumed to be aware of and familiar with this E-Course and Community Membership Site Terms and Conditions Agreement. Any member, candidate or individual who is found to be violating or assisting or attempting to assist anyone in violating these Terms and Conditions is subject to the regulations and/or any action that Jamie Graff Smith and LUXE Everyday Inc. is authorized to take, including disciplinary action.
E-Course and Community Membership Site Management System Access
You agree that you will not use any robot, spider or other device, process or means to access the e-course or membership site. Nor shall you use any process to monitor or copy our web pages or the content contained thereon or for any other unauthorized purpose without our prior expressed written permission. You agree that you will not compromise or circumvent the security controls of Jamie Graff Smith and LUXE Everyday Inc. courses and membership site or otherwise gain unauthorized access to said courses and membership site. You agree that you will not use any device, software or routine that interferes with the proper working of the courses or membership site nor shall you attempt to interfere with the proper working of the courses or membership site. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on our infrastructure. Transfer
This agreement cannot be transferred or assigned to any third party without written consent from both parties.
Severability
In the event that any part of this Agreement is found to be invalid or unenforceable, the remainder of this Agreement shall remain valid and enforceable. Any failure by one or both parties to enforce a provision of this Agreement shall not constitute a waiver of any other portion or provision of this agreement.
